Subject: Urgent Request for the Deployment of a UN Protection Force for Palestinian Civilians in the West Bank

Excellencies,

We are writing to you with the utmost urgency to request the immediate deployment of a United Nations protection force to the occupied West Bank. This request is necessitated by the systemic failure of the State of Israel, the Occupying Power, to protect Palestinian civilians from an escalating wave of violent attacks. Tragically, innocent civilians—including children, the elderly, and adults—are being killed through no fault of their own. In recent months, we have witnessed a severe and continuous surge in the intensity and frequency of these violent acts against Palestinian residents, their lives, and their lands.

Furthermore, innocent residents are being forcibly displaced and expelled from their homes and villages for the sole purpose of allowing settlers to seize their properties and take over their lands.

Under international law, specifically the Fourth Geneva Convention of 1949, Israel bears a clear legal obligation to ensure the safety and well-being of the protected population under its control.

Article 49 of the Fourth Geneva Convention explicitly prohibits the Occupying Power from transferring parts of its own civilian population into the territory it occupies, and strictly forbids individual or mass forcible transfers as well as deportations of protected persons from occupied territory. The establishment and expansion of settlements are a direct violation of this treaty. Consequently, the friction and violence emanating from these illegally transferred populations are a structural outcome of this violation.

Tragically, the current Government of Israel has demonstrated not only an unwillingness to fulfill these obligations but an active policy of support for settler violence and expansion. We wish to bring the following critical failures to your attention:

• Active Military Participation and Fatalities: In numerous documented incidents, soldiers of the Israel Defense Forces (IDF)—the sovereign military authority in the territory—have actively participated in settler assaults against Palestinian villages and agricultural lands.

• Military Inaction and Complicity: When settlers attack Palestinian communities, IDF units frequently stand by, observing the violence without intervening to stop the perpetrators or protect the victims.

• Law Enforcement Immunity: The Israel Police and the military authorities systematically fail to arrest, investigate, or prosecute settlers who engage in riots and violence. Instead, Palestinian victims are often the ones detained or interrogated.

As the sovereign power on the ground, the Israeli military and police have abdicated their responsibility to maintain public order and safety for the Palestinian population. The open support of government officials for settlement expansion and settler impunity has created an environment of lawlessness and bloodshed.

In light of the Occupying Power's failure to uphold the Fourth Geneva Convention, we urge the United Nations Security Council to exercise its mandate under the UN Charter and deploy an international protection force to prevent further loss of life and secure the human rights of Palestinian civilians.

We thank you for your urgent attention to this humanitarian crisis.

אנו פונים אליכם בדחיפות עליונה בבקשה לשגר באופן מיידי כוח הגנה מטעם האומות המאוחדות לגדה המערבית. בקשה זו נולדה מתוך הכשל המערכתי של מדינת ישראל, הכוח הכובש, להגן על האזרחים הפלסטינים מפני תקיפות אלימות. למרבה הצער, אזרחים חפים מפשע – בהם ילדים, מבוגרים וקשישים – נרצחים ונהרגים על לא עוול בכפם. בחודשים האחרונים אנו עדים להתגברות גוברת והולכת, חמורה ורצופה, של מעשי אלימות אלו כלפי התושבים הפלסטינים וחייהם.

יתרה מזאת, תושבים מגורשים מבתיהם ומכפריהם על מנת שהמתנחלים ישתלטו על הרכוש והאדמות ויגורו בהם.

על פי המשפט הבינלאומי, ובפרט אמנת ז'נבה הרביעית (1949), על ישראל חלה חובה משפטית ברורה להבטיח את שלומם וביטחונם של התושבים המוגנים הנתונים לשליטתה.

סעיף 49 של אמנת ז'נבה הרביעית אוסר במפורש על המעצמה הכובשת להעביר חלקים מאוכלוסייתה האזרחית אל השטח הכבוש, ואוסר בתוקף גירוש או העברה בכפייה של תושבים מוגנים מתוך השטח הכבוש. הקמת ההתנחלויות והרחבתן מהוות הפרה ישירה של אמנה זו. כפועל יוצא, החיכוך, הגירוש והאלימות הנובעים מנוכחותה של אוכלוסייה זו הם תוצר מבני של ההפרה האמורה.

למרבה הצער, ממשלת ישראל הנוכחית מפגינה לא רק חוסר רצון למלא את התחייבויותיה אלה, אלא מובילה מדיניות אקטיבית של תמיכה באלימות המתנחלים ובהתרחבותם. אנו מבקשים להביא לתשומת לבכם את הכשלים הקריטיים הבאים:

• השתתפות פעילה של חיילים: באירועים מתועדים רבים, חיילי צבא ההגנה לישראל (צה"ל) – הריבון הצבאי בשטח – השתתפו באופן פעיל בתקיפות של מתנחלים נגד כפרים פלסטינים ואדמות חקלאיות.

• עמידה מן הצד ומחדל צבאי: כאשר מתנחלים תוקפים קהילות פלסטיניות, יחידות צה"ל עומדות לעיתים קרובות מן הצד וצופות באלימות מבלי להתערב כדי לעצור את הפורעים או להגן על הקורבנות.

• חסינות מצד רשויות אכיפת החוק: משטרת ישראל והרשויות הצבאיות נכשלות באופן מערכתי במעצר, חקירה או העמדה לדין של מתנחלים המשתתפים בהתפרעויות ובמעשי אלימות. במקום זאת, לעיתים קרובות דווקא הקורבנות הפלסטינים הם אלו שנעצרים או נחקרים.

כריבון בשטח, הצבא והמשטרה זנחו את אחריותם לשמירה על הסדר הציבורי ועל ביטחון האוכלוסייה הפלסטינית. התמיכה הגלויה של גורמי ממשל בהרחבת ההתנחלויות ובמתן חסינות למתפרעים יצרה סביבה של הפקרות ושפיכות דמים.

לאור כישלונו של הכוח הכובש לעמוד בהוראות אמנת ז'נבה הרביעית, אנו קוראים למועצת הביטחון של האו"ם להפעיל את המנדט שברשותה מכוח מגילת האו"ם, ולפרוס כוח הגנה בינלאומי על מנת למנוע אובדן נוסף של חיי אדם ולהבטיח את זכויות האדם של האזרחים הפלסטינים.
