כבוד השרים,

הנדון: האם אדם שהואשם בגרימת מוות ברשלנות תוך נהיגה בפזיזות יכול לייצג אותנו בעולם?!?!

אנו אזרחי מדינת ישראל איננו מוכנים בשום אופן שאדם אשר הורשע בבית המשפט בנהיגה רשלנית ופושעת וגרם למותם של 2 בני אדם ולפציעתו האנושה של אדם שלישי, ייצג את מדינת ישראל ברחבי העולם.

כבוד השרים, אנו פונים לליבכם, בנוגע לתאונת הדרכים הנוראית מיום 20.8.08 בכביש גהה, בה נהג השחיין האולימפי הנכה יצחק ממיסטבלוב, אשר גרם למותם של מרדכי חסידים ז"ל, אווה טייב ז"ל וכן לפציעתה האנושה של גברת פרידמן, שעמדו לתומם בתחנת האוטובוס. הדורס הורשע כי נסע בפראות וברשלנות, במהירות מופרזת, חתך  3 נתיבים, נתקע בתחנת האוטובוס ודרס למוות את השניים ופצע את השלישית.

מאז התאונה הנוראית המשיך הדורס בחייו כרגיל, טס לתחרויות בחו"ל, ואף זכה במדליות ובהישגים, ובה בעת לא הופיע במרביתם ככולם של הדיונים בבית המשפט, ואף ננזף על כך ע"י השופט. לעומת הדורס, חיי המשפחות עמדו דום וליבם שותת דם מאז.

לצערנו, בית המשפט גזר "עונש" מגוחך של שלילת הרישיון, ושעות שירות לקהילה. עונש זה הינו לעג לרש!! ביום 22.7.10 בעת מתן גזר הדין, פנו המשפחות לשופט, כואבות ושותתות דם בדרישה שישללו אותו מלייצג את מדינת ישראל בחו"ל. השופט אמר כי ידיו כבולות בערכאה זו אך הביע את דעתו בעניין ואף פנה לצו מצפונו של ממיסטבלוב שיפסול עצמו מהמשחקים האולימפיים, לפחות לתקופת צינון. ממיסטבלוב לא התייחס לפניית השופט.

האם יתכן שבמדינת ישראל אדם שנאשם והודה גרם מוות ברשלנות ובנהיגה בפזיזות ורשלנות יכול לייצג את המדינה? האם נתייחס לאדם כזה כגיבור לאומי ?  האם במקום לשבת בכלא הוא ימשיך לטייל בתחרויות בעולם ולייצג את מדינתנו, כאילו לא הרג כלל?! כאילו לא פצע?! האם העובדה שהוא נכה פוטרת אתו מלקחת אחראיות על מעשיו ?

למשפחות ההרוגים אין עניין במסע נקם בדורס והן מכבדות את פסיקת בית המשפט. כל שאנו רוצים הוא לפעול למען עשיית צדק בסיסי. ברצוננו לפעול לכל הפחות למניעת יציאתו מהארץ לתחרויות ספורט בהן הוא מייצג את ישראל.

אנו פונים אליכם בעצומה זו, מתוך אמונה בממשלת ישראל, ולמען מעורבות הדדית ולקיחת אחריות. ברצוננו לפעול לתיקון העוול ולמניעת הרג מיותר בעתיד. אנו פועלים למען זכרם של ההרוגים, אשר אינם יכולים כבר לזעוק את זעקתם, ולמען זכרם של כל ההרוגים שנהרגו בכבישי ישראל באשר הם.

אסור שאדם כזה ימשיך לייצג את כולנו בעולם!!!!!!!! עזרו לנו למען כולנו ולמניעת תאונות הדרכים והקטל בכבישים ולהרתעת נהגים רשלניים אשר הפכו למכת מדינה!!!!

נא כנסו בדחיפות וחיתמו למען כולנו, למען כל הנופלים בתאונות הדרכים, למניעת שפיכות דמים מיותרת בכבישי ישראל

 Should a man found guilty of killing two people while driving recklessly represent Israel in sports competitions around the world?!?!? Dear Ministers:We are approaching you in regards to the horrible accident which took place on the 20 of August, 2008 on Geha Road in Givat Shmuel where the handicap Olympic swimmer, Itzhak Mamistavlov, caused the death of Mordechai Hassidim (of blessed memory) and Eva Taieb (of blessed memory) and seriously injured Mrs. Friedman while they were standing at a bus station. The driver was convicted of killing while driving recklessly at high speeds, crossing suddenly over three lanes of traffic, and striking three innocent bystanders.  The killer, handicap from birth and paralyzed in three of his limbs, fought for several years to obtain his driver’s license against the odds and for selfish reasons without thinking about the risks his driving poses to public safety. It is unfortunate that the driver’s license he obtained turned into a license to kill. In contrast to the family members of the victims’ whose hearts were broken and lives came to a halt, his life continues as normal; he flies abroad to represent Israel in swimming competitions and even brings home medals. Unfortunately, his punishment from the court is a slap on the wrist consisting of the mere revoking of his license. The media, like the courts, has been overly sympathetic to the killer, portraying him as the victim by sharing his life story and glorifying his exploits at the Special Olympic Games. Both the lack of real punishment from the court and the overly sympathetic media coverage has caused additional heartache to the victims’ families who are, in any event, devastated. Is it reasonable that in the State of Israel that a man convicted of killing can be a national hero? Rather than serving a prison sentence, he continues to travel the world representing the Israeli people at competitions abroad as though he has done nothing wrong. Should the fact that he is handicap absolve him of his responsibility for killing innocent people? The families of the victims are not seeking revenge and are respecting  the decision of the court, however, feel strongly, that at the very least he should be prevented from travelling abroad to represent Israel.
